{"id":3768,"date":"2019-07-25T18:35:07","date_gmt":"2019-07-25T18:35:07","guid":{"rendered":"https:\/\/www.animalhealthfoundation.net\/blog\/?p=3768"},"modified":"2019-07-25T18:35:28","modified_gmt":"2019-07-25T18:35:28","slug":"champion-pet-food-lawsuit-amended-to-include-dcm-and-other-concerns","status":"publish","type":"post","link":"https:\/\/www.animalhealthfoundation.org\/blog\/2019\/07\/champion-pet-food-lawsuit-amended-to-include-dcm-and-other-concerns\/","title":{"rendered":"Champion Pet Food Lawsuit Amended to include DCM and other concerns"},"content":{"rendered":"<p>https:\/\/truthaboutpetfood.com\/champion-pet-food-lawsuit-amended-includes-dcm-and-other-concerns\/<\/p>\n<p>The lawsuit doesn\u2019t appear to be officially accusing Champion of causing DCM, but it appears to be opening the door for that potential in the future.<\/p>\n<p>The\u00a0<a href=\"https:\/\/truthaboutpetfood.com\/lawsuit-filed-against-champion-pet-food-acana-and-orijen\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"original lawsuit against Champion Pet Food (opens in a new tab)\">original lawsuit against Champion Pet Food<\/a>\u00a0filed in March 2018 included claims of \u201c<em>negligent, reckless, and\/or intentional practice of misrepresenting and failing to fully disclose the presence of heavy metals and toxins in their pet food\u00a0<\/em>\u201c.<\/p>\n<p><a href=\"https:\/\/truthaboutpetfood.com\/champion-pet-food-lawsuit-amended-risk-of-inclusion-of-pentobarbital\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"An amended complaint was filed in November 2018 (opens in a new tab)\">An amended complaint was filed in November 2018<\/a>, adding \u201c<em>pentobarbital<\/em>\u201d risk to the lawsuit. Quoting the amended lawsuit against Champion:\u00a0<em>\u201cIt was recently revealed on information and belief that Defendants were knowingly, recklessly and\/or negligently selling certain of the Contaminated Dog Foods from the DogStar Kitchens containing pentobarbital, a substance largely used to euthanize animals.\u201d<\/em><\/p>\n<p><a href=\"https:\/\/truthaboutpetfood.com\/champion-lawsuit-amended-non-regional-and-non-fresh-ingredients\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"An amended complaint (opens in a new tab)\">And another amended complaint<\/a>\u00a0was filed in February 2019 challenging Champion Pet Food\u2019s marketing claims of \u201c<em>regional<\/em>\u201d and \u201c<em>fresh<\/em>\u201d ingredients. This amended complaint stated: \u201c<em>It was recently revealed on information and belief that Defendants were knowingly, recklessly, and\/or negligently selling certain of the Contaminated Dog Foods from the DogStar\u00ae Kitchens containing pentobarbital that was caused by cross-contamination that resulted from its supplier, MOPAC, an eastern Pennsylvania rendering facility belonging to JBS USA Holdings, Inc. (\u201cJBS\u201d), having accepted and processed euthanized horses in earlier production runs for other customers<\/em>.\u201d<\/p>\n<p>This third amended complaint against Champion Pet Food includes the following two mentions of DCM (dilated cardiomyopathy):<\/p>\n<blockquote class=\"wp-block-quote\"><p>\u201cAdditionally, on July 12, 2018, the FDA issued a warning that \u201cdogs eating certain pet foods containing peas, lentils, other legume seeds, or potatoes as main ingredients\u201d were experiencing DCM, a heart muscle disease that results in an enlarged heart. \u201cAs the heart and its chambers become dilated, it becomes harder for the heart to pump, and heart valves may leak, leading to a buildup of fluids in the chest and abdomen. DCM often results in congestive heart failure.\u201d Thereafter, on June 27, 2019, the FDA released a report of its investigation into DCM that disclosed Defendants\u2019 brands account for 14.88 percent of reported cases of DCM in the past 5 years. Defendants were aware of the risk and the reported cases associated with the Contaminated Pet Foods from at least July 2018 and yet chose not to include any warning or link to the FDA investigation into DCM.\u201d<\/p><\/blockquote>\n<blockquote class=\"wp-block-quote\"><p>\u201cYet, Defendants warrant, promise, represent, mislead, label, and\/or advertise that the Contaminated Dog Foods are free of heavy metals, pentobarbital, toxins, BPA, and\/or unnatural or other ingredients and would not pose a risk for pets developing Dilated Cardiomyopathy (\u201cDCM\u201d) by touting the Contaminated Dog Food as \u201cBiologically Appropriate\u2122\u201d (a nutritional statement) and assuring the food represents an evolutionary diet that mirrors that of a wolf\u2014free of anything \u201cnature did not intend for your dog to eat.\u201d<\/p><\/blockquote>\n<p>Other interesting issues of this amended lawsuit \u2013 but not fully explained in the complaint \u2013 are (item 166 found on page 76 \u2013 bold added):<\/p>\n<blockquote class=\"wp-block-quote\"><p>\u201cDefendants knew or should have known that the Contaminated Dog Foods did not have the ingredients, uses, and benefits described herein because:<\/p>\n<p>They\u00a0<strong>contain ingredients that are frozen, stored for years, and\/or expired prior to manufacturing<\/strong>\u00a0or composed of regrind kibble;<\/p>\n<p>They are\u00a0<strong>routinely manufactured with substitute ingredients<\/strong>\u00a0not included in the Ingredient List, MeatMath\u00ae, or nutritional analysis;\u201d<\/p><\/blockquote>\n<p>Lots of questions remain \u2013 unfortunately we\u2019ll have to wait to see how this lawsuit unfolds for answers.<\/p>\n<p>To read the full amended Champion Pet Food complaint,\u00a0<a href=\"https:\/\/www.locklaw.com\/wp-content\/uploads\/2019\/07\/2019-07-22-Champion-Pet-Foods-Third-Amended-Complaint-Wisconsin.pdf\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"Click Here (opens in a new tab)\">Click Here<\/a>.<\/p>\n<p>Wishing you and your pet(s) the best,<\/p>\n<p>Susan Thixton<br \/>\nPet Food Safety Advocate<br \/>\nAuthor Buyer Beware, Co-Author Dinner PAWsible<br \/>\n<a href=\"https:\/\/www.truthaboutpetfood.com\/\">T<\/a>r<a href=\"https:\/\/www.truthaboutpetfood.com\/\">uthaboutPetFood.com<\/a><br \/>\n<a href=\"http:\/\/www.associationfortruthinpetfood.com\/\">A<\/a>s<a href=\"http:\/\/www.associationfortruthinpetfood.com\/\">sociation for Truth in Pet Food<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>https:\/\/truthaboutpetfood.com\/champion-pet-food-lawsuit-amended-includes-dcm-and-other-concerns\/ The lawsuit doesn\u2019t appear to be officially accusing Champion of causing DCM, but it appears to be opening the door for that potential in the future.
